Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kintact ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Acceptance of Terms

  1. By using Kintact, you confirm that you are at least 18 years old or have the consent of a parent or guardian.
  2. These Terms constitute a legally binding agreement between you and Kintact.
  3. We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

  1. Kintact provides a digital vault for storing and accessing emergency contact information for families.
  2. The Service is provided free of charge and is intended for personal, non-commercial use only.
  3. We strive to maintain 99% uptime but do not guarantee uninterrupted or error-free service.

3. User Responsibilities

  1. You are responsible for maintaining the confidentiality of your family PIN and for all activities that occur under your account.
  2. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
  3. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.
  4. You are solely responsible for ensuring that your use of the Service complies with all applicable laws and regulations.

4. Data Storage and Security

  1. While we implement reasonable security measures to protect your data, you acknowledge that no method of transmission over the internet or electronic storage is 100% secure.
  2. We cannot guarantee absolute security and are not liable for unauthorized access resulting from security breaches beyond our reasonable control.
  3. You acknowledge that you store information in our Service at your own risk.

5. Content Accuracy

  1. You are solely responsible for the accuracy and completeness of the contact information you store in Kintact.
  2. We do not verify the accuracy of any information entered into the system.
  3. You agree to indemnify and hold harmless Kintact from any claims arising from inaccurate or incomplete information you provide.

6. Emergency Service Limitations

  1. KINTACT IS NOT AN EMERGENCY RESPONSE SERVICE.
  2. In life-threatening situations, you should always call local emergency services (911 in the US, 999 in the UK, 112 in EU, etc.) directly.
  3. Kintact is designed to facilitate communication among family members during emergencies, not to replace professional emergency services.

7. Prohibited Uses

You may not use the Service to:

  1. Violate any applicable law or regulation
  2. Infringe upon the rights of others
  3. Store or transmit malicious code or viruses
  4. Attempt to gain unauthorized access to any part of the Service
  5. Use the Service in any way that could disable, overburden, or impair the Service
  6. Use the Service for any commercial purpose without our express written consent

8. Limitation of Liability

  1. KINTACT AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
  2. This includes damages resulting from the use or inability to use the Service, including but not limited to reliance on emergency contact information stored in the system.
  3. Our total liability to you for any claim arising from your use of the Service shall not exceed $100 USD.

9. Service Modifications

  1. We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
  2. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.
  3. We may release new features, change existing features, or remove features as we continuously improve the Service.

10. Termination

  1. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.
  2. Upon termination, your right to use the Service will immediately cease.
  3. If you wish to terminate your account, you may simply discontinue using the Service and delete your family vault.

11. Governing Law

  1. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
  2. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Wilmington, Delaware.
  3. You hereby consent to personal jurisdiction and venue therein.
